This page sets out the terms of use of this website (Website Terms of Use).  By using this website, you accept all of its terms (including these Website Terms of Use and the Privacy Policy).  A reference in these Website Terms of Use to ‘we’, ‘us’ or ‘our’ means ClassHive Pty Ltd and any related bodies corporate. 
We reserve the right to update or amend these Website Terms of Use at any time.  You should check this page from time to time to make sure you are aware of any changes.

This website includes publicly-accessible content, as well as functionality for Australian education institutions to register for access to the ClassHive Platform (the Platform).  These Website Terms of Use apply to this website generally, including the Platform, and any reference to this website includes the Platform.  The Service Terms below also apply to the Platform.

Website content

The content provided by us on this website is owned or controlled by us and is protected by copyright laws in Australia and overseas.  You may only use the content for your own personal purposes, and may not otherwise use, copy, reproduce, modify, publish or transmit the content without our prior written consent.

We use reasonable endeavours to ensure that the information we include on this website is accurate and up-to-date, but we cannot guarantee the accuracy, currency or completeness of the information provided and we accept no responsibility for errors in the content at any time.  We do not guarantee that use of our website will be uninterrupted or error-free, or that materials accessible on or through the website will be free from errors, viruses, worms or other harmful codes.  To the extent permitted by law, all liability is excluded for any loss (including indirect loss), damages or injury resulting from your access to (or inability to access) or use of this website, or as a consequence of any content or information obtained from or through this website.

ClassHive Service Terms

ClassHive Pty Ltd (ClassHive) provides a subscription service to Australian education institutions to access the ClassHive Platform, which is a tool to enable centralised access to third party educational apps and websites (ClassHive Platform, or Platform).

These Service Terms apply to the Platform and may be updated from time to time.  The Service Terms are in addition to our Website Terms of Use and your use of the Platform is also subject to the Website Terms of Use.  By registering to access, accessing or using the Platform, you agree to these Service Terms, the Website Terms of Use and the Privacy Policy, as they exist at that time.

ClassHive may at any time (without prejudice to its other rights or remedies) immediately terminate or suspend your right to access any or all of the Platform if you fail to comply with the Service Terms or the Website Terms of Use.

A reference in these Service Terms to ‘we’, ‘us’ or ‘our’ means ClassHive.  A reference to ‘you’ and ‘your’ in these Service Terms means the Australian educational institution that registers to access the Platform.

1. Eligibility

1.1 To be eligible to register to use the ClassHive Platform, you must be an Australian educational institution. 

2. Account creation and access

2.1 By registering to use the Platform, you acknowledge and agree that your representative is agreeing on your behalf to be bound by these Service Terms, the Website Terms of Use and the Privacy Policy and you warrant that your representative has the authority to agree to these terms on your behalf.

2.2 Before using and accessing the Platform, you will need to:

  • (a) register and provide details about your school;
  • (b) provide details about your school’s principal, including their name and email;
  • (c) nominate a Platform Administrator (the individual who will be the nominated controller of your account to use the Platform) and provide their details, including their name, email and phone number;
  • (d) provide details about each teacher that will access the ClassHive Platform, including their name, email and class name; and 
  • (e) provide details about each student that will access the ClassHive Platform, including their name, class name and (optional) email address. 

You must obtain consent from each relevant individual and, if the individual is under the age of 18 years, from their parent or guardian before providing their personal information to us.  

2.3 To use the Platform, you must have Internet access and provide a current, valid, accepted method of payment, which you may update from time to time (Payment Method).

2.4 When you register to use the ClassHive Platform and provide all of the required details, we will provide you with a username and password for the Platform Administrator and for each teacher and student that you have registered to use the ClassHive Platform.  Only the Platform Administrator and the teachers and students you have registered with us may use the ClassHive Platform and must log in to the ClassHive Platform using their allocated username and password.  Each ClassHive Platform username and password may only be used by the person to which it was allocated and must not be shared with or provided to any other person. 

2.5 You must maintain the confidentiality of your username and password and, you must ensure that the Platform Administrator and each of your teachers and students maintain the confidentiality of their allocated username and password.  You are responsible for all activities that are conducted through your account whether or not you have authorised such use.

2.6 You are responsible for updating and maintaining the accuracy of the information you provide to us relating to your account.

3. Use of Platform and content

3.1 The Platform is for educational use by your educational institution and your teachers and students only and must not be used for any other purpose, including commercial purposes.  You must not, and must ensure that your teachers and students do not, publish, adapt, reproduce, communicate to the public, distribute to third parties, offer for sale, license, create derivative works from, amend or make any other copy of any part of the content on the Platform without our prior written consent.

3.2 During your Platform subscription, we grant you (and each of your teachers and students) a limited, non-exclusive, non-transferable licence to access the Platform for educational purposes at your educational institution only (with no right to sub-license).  

3.3 You agree to use, and to ensure that your teachers and students use, the Platform, including all features, functionalities and content, in accordance with applicable laws, rules and regulations, or other restrictions on use of the Platform or its content. 

4. Third party apps 

4.1 The ClassHive Platform provides teachers and students with centralised access to third party apps and websites selected by you (Third Party Apps).  We are not responsible or liable for the content of any Third Party Apps, and access to and use of the Third Party Apps by you, your teachers and students, is at your own risk.  

4.2 You acknowledge that Third Party Apps are subject to their own terms and conditions, and you must comply with, and ensure that your teachers and students comply with, all terms and conditions applicable to the Third Party Apps, including having a valid account with such Third Party Apps.  

5. Payment

5.1 The ClassHive Platform subscription fee is an annual fee calculated according to the number of students you register to access the ClassHive Platform. 

5.2 The Platform subscription fee will be charged to your Payment Method and will continue year-to-year until you cancel your account.  Unless you cancel your account before your yearly billing date, you authorise ClassHive to charge the next year's subscription fee to your Payment Method.  

5.3 The subscription fee for the Platform and any other charges you may incur in connection with your use of the Platform including taxes and any transaction fees, will be charged to your Payment Method on a yearly basis on the first day of the calendar month following the date you first registered to use the Platform.  Your payment date may change in certain circumstances, for example if your payment was unsuccessful or delayed for any reason.  

5.4 ClassHive may use a third party payment service provider to process payments due to ClassHive and you may be required to agree to additional terms between you and the third party payment service provider in order to pay for and use the Platform.

5.5 If a payment is not successful including due to issues with your Payment Method (for example, expiration of your Payment Method or insufficient funds) and you do not update your Payment Method or cancel your account, ClassHive may cancel your account or suspend access to the Platform until payment has been received.  You remain responsible for any outstanding payments owing to ClassHive and authorise ClassHive to charge any outstanding payments to your updated Payment Method.

5.6 ClassHive may change the subscription fee for the Platform from time to time and will provide you with at least 30 days’ notice before the change to the subscription fee comes into effect.  If you do not agree to the change in the subscription fee, you may cancel your subscription at any time before the end of your current yearly billing period.  

5.7 You may cancel your subscription to use the Platform at any time and you will continue to have access to the Platform through to the end of your yearly billing period.  To cancel, please contact us at info@classhive.com.au  .
